1. Provider and scope
1.1 The game Superkrass and the website superkrass.com are provided by Hypez LTD, Office TW, Greengate Business Centre, Oldham, OL4 1FN, United Kingdom, company number [[COMPANY NUMBER]], represented by its director Ismail Ramadan, email: hallo@superkrass.com ("we", "us").
1.2 These terms apply to using Superkrass in the browser and in the apps, and to purchases inside the game. Terms set by users do not apply.
1.3 For purchases in the apps, the terms of the relevant app store (Apple App Store, Google Play) also apply.
2. The game
2.1 Superkrass is an online game in which two players fight each other with boss characters. A duel has up to three rounds of about 60 seconds. The first to win two rounds wins the duel.
2.2 The game is free to play. Players can buy Blitze for money (section 6).
2.3 The game needs an internet connection. We aim for high availability but cannot promise the game will always be reachable. Maintenance and outages outside our control can happen.
3. Player account
3.1 When you first open the game, our server creates a guest account automatically. Your device stores a random key for it. Your game state is kept on our server and linked to that key. Every account has a player ID shown in the profile menu.
3.2 If you clear your browser data, switch devices or lose your device, the guest account can be lost. This includes Blitze, cards and other content on the account. As long as you have not secured your account with a sign-in, we cannot promise to restore it. We will help case by case if the account can be clearly identified by its player ID or a receipt.
3.3 Sign-in with Google or Apple is planned. It is meant to let you use your game state on several devices.
3.4 Your account is personal. Selling, swapping or handing over accounts for money is not allowed.
4. Minors
4.1 The game has no age restriction.
4.2 Minors may only make purchases with real money with the consent of a parent or guardian. Under German law, a contract made by a minor without this consent is provisionally invalid, unless the minor pays with money given to them for that purpose or for free use (§ 110 BGB, "pocket money rule").
4.3 Parents and guardians with questions about their child's purchases can contact hallo@superkrass.com. In the apps, Apple's and Google's parental controls are also available.
5. Virtual currencies and content
5.1 There are two currencies in the game. Konfetti are earned by playing and are the stake for online duels. Without Konfetti, you cannot play an online duel. Blitze are a premium currency bought with real money. Blitze can be used to get boss cards, boosters, Boombox content and other items.
5.2 Konfetti, Blitze, boss cards, boosters and other virtual content are not legal tender and not e-money. They have no monetary value outside the game. You receive a simple, non-transferable, revocable right to use them in the game under these terms. You do not acquire ownership of them.
5.3 Virtual content cannot be exchanged back into real money, transferred to other players or traded outside the game. Your statutory rights, in particular your right of withdrawal and your rights for defective digital content, are not affected.
5.4 Duels with friends via an invite link are free.
5.5 The Boombox is a reward after wins and contains randomly selected content, such as boss cards. The possible contents [[verify: and their odds]] are shown in the game.
6. Buying Blitze
6.1 Blitze are offered in packs of 100, 550 and 1,200. Prices are shown at checkout before you buy. No VAT is charged, as Hypez LTD is not registered for VAT. [[verify]]
6.2 Showing the packs in the game is not a binding offer. By clicking the order button, you make a binding offer. The contract is concluded when the payment is confirmed and the Blitze are credited to your account.
6.3 In the browser, purchases run through RevenueCat Web Billing, with payment processing by Stripe. In the apps, purchases run through the Apple App Store or Google Play. The store's own rules for payment, receipts and refunds apply there.
6.4 Our server credits the Blitze you bought to your player account, usually within a few minutes. If Blitze do not arrive, please contact hallo@superkrass.com with your player ID and your receipt.
6.5 We send you confirmation of the contract on a durable medium, usually by email to the address given at checkout or through the app store.
7. Right of withdrawal
Consumers have a right of withdrawal as set out in the withdrawal policy. The right ends early if you expressly agreed that we start providing the content before the withdrawal period ends and confirmed that you lose your right of withdrawal by doing so (§ 356(5) BGB).
8. Boss cards and losing cards
8.1 The boss Miezi is free to play. All other bosses are played with boss cards.
8.2 If you win a duel with a boss card, you keep the card. If you lose, the card you played is lost and removed from your account. This rule is part of how the game works and also applies to cards bought with Blitze. There is no right to replacement or refund.
8.3 If a duel breaks off because of a technical fault on our side, the card does not count as lost. [[verify: rule when a player disconnects or leaves the duel]]
8.4 Does the card loss rule also apply to duels via invite link? [[verify]]
8.5 You can get boss cards from the Boombox, in the shop and as league prizes.
9. League, Lucky Spin and boosters
9.1 Each league has ten ranks and runs in weekly seasons. Wins earn trophies. At the end of a season, prizes are given out by rank. We may change prizes and season rules for future seasons.
9.2 The Lucky Spin wheel can be spun once a day for free.
9.3 Two boosters can be equipped per duel. Each booster can be used once per round and is used up when it is used.
10. Fair play
10.1 In particular, the following are not allowed:
- cheats, bots, macros, or modifying the game client or its network traffic,
- exploiting bugs instead of reporting them,
- arranged duels to shift cards, trophies or prizes,
- creating many accounts to collect rewards several times,
- attacking our servers or getting around technical protections,
- charging back payments for Blitze that were already used without a valid reason.

11. Action on breaches, termination
11.1 If you break these terms, we may, depending on how serious it is, warn you, remove content gained unfairly, suspend your account temporarily or close it for good. We take your legitimate interests into account.
11.2 You can stop playing at any time and ask us to delete your account. When an account is deleted, all content on it is lost.
11.3 We may terminate the contract with [[NOTICE PERIOD]] notice. The right to terminate without notice for good cause is not affected. If we terminate with notice although you have not broken these terms, we refund the value of unused purchased Blitze on a pro rata basis.
12. Changes to the game
12.1 We keep developing the game. We may change content, bosses, stats, in-game prices and mechanics if there is a valid reason, such as balancing, security, technical development or legal requirements, and this costs you nothing extra (§ 327r BGB).
12.2 If a change affects your access to or use of purchased content more than slightly, we will tell you in advance. You can then end the contract free of charge within 30 days.
12.3 If we shut the game down, we will announce it at least [[SHUTDOWN NOTICE PERIOD]] in advance. Section 11.3, last sentence, applies to unused purchased Blitze.
13. Defects
Statutory rules apply to defects, for consumers in Germany in particular §§ 327 et seq. BGB. We provide updates needed to keep the game in conformity with the contract.
14. Liability
14.1 We are liable without limitation for intent and gross negligence, for injury to life, body or health, under product liability law and to the extent of any guarantee we gave.
14.2 For slightly negligent breach of an essential contractual duty, liability is limited to the typical, foreseeable damage. Essential duties are those that make proper performance of the contract possible in the first place and on which you may regularly rely.
14.3 Otherwise, liability for slight negligence is excluded.
14.4 These limits also apply to our staff and agents.
14.5 Nothing in these terms limits liability that cannot be limited under applicable law, including under the UK Consumer Rights Act 2015.
15. TikTok LIVE and creators
15.1 Creators can connect their TikTok LIVE to Superkrass. They are responsible for following TikTok's rules. Superkrass is not affiliated with TikTok.
15.2 Creator characters, revenue shares and referral rewards are governed by the individual creator agreement. A non-binding overview is in the creator summary.
16. Changes to these terms
We may change these terms for the future if there is a valid reason, such as new features or a change in the law. We will inform you in the game at least [[TERMS CHANGE NOTICE PERIOD]] before changes take effect. We will not change essential parts of the contract to your disadvantage on our own, such as content already bought and its price.
17. Governing law, courts, consumer rights
17.1 Hypez LTD is a company based in the United Kingdom.
17.2 The law of England and Wales applies [[verify: alternatively German law]], excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer habitually resident in the EU, you keep the protection of the mandatory consumer protection rules of your country of residence. The choice of law does not take that protection away.
17.3 As a consumer, you can also bring proceedings in the courts where you live.
17.4 We are neither willing nor obliged to take part in dispute resolution before a consumer arbitration board. [[verify]]
18. Final provisions
If a provision is invalid, the rest of the contract stays valid and the statutory rules apply instead. These terms are available in German and English. For consumers in Germany, the German version prevails in case of differences. [[verify]]
